What to Look for While Hiring a Timeshare Cancellation Lawyer?

If you want to escape the financial burdens of a devious timeshare contract, you may need to hire a timeshare cancellation lawyer. Whether you are cancelling the contract within the rescinding period or not, you may want the help of a lawyer to navigate the processes.

With so many attorneys out there, where do you start? It’s all about finding a specialist. Make sure to consider the following qualities when looking for the best timeshare cancellation lawyer:

Focuses on timeshare litigation

The right timeshare cancellation lawyers have represented many clients in a similar situation as you. Before they engage in timeshare litigation, they will investigate the finer details of the contracts and the obligations of both parties. Seasoned lawyers are highly skilled in finding out information that can be used as evidence to support the buyer's claims. They are experts in various customer protection laws.

Experienced in negotiation or arbitration

The best timeshare cancellation lawyers are not always in court debating with the timeshare company lawyer. They find ways to avoid filing a lawsuit and going through the tedious process of timeshare litigation. Instead, they will ask for cancellation consent from the timeshare company. This option is better as it is quicker and less expensive. They possess negotiation skills and can get a fair settlement with the timeshare company.

Asks for a reasonable service fee

You don't need to pay hefty legal fees for the service rendered by a timeshare cancellation lawyer. You can hire attorneys who provide quality consulting and representation at reasonable rates. You can even find a lawyer who gives advice, opinions, and assessments for free.

There are many lawyers, but only a handful specialize in timeshare litigation. It can be difficult to seek a specialist on your own. It’s best to ask for assistance or referrals from a financial services firm that specializes in consumer advocacy.

Learn All About Timeshare Cancellation Rights

Most people believe that timeshare contracts cannot be cancelled or terminated. However, if you have recently purchased a timeshare property and you change your mind, you can still back out as long as the contract is still within the cancellation period. You can legally cancel timeshare contract within that given time. For instance, in Florida, you may do so within 10 days—and the company is obliged to give you a full refund. This means you need to act quickly.

There are many reasons to cancel a timeshare contract. Apart from having a change of heart, some people may want out if they realize that it will be expensive to maintain in the long run. Timeshares typically come with various costs, like maintenance fees that are subject to change and increase regardless of whether you use the property or not. You will have to pay for taxes, mortgage, and ownership fees, too. You may also cancel if you do not wish to pass the burden of owning and maintaining a timeshare to your family. Contracts are typically good for a lifetime so they can be passed down to future generations—whether your heirs or beneficiaries want the property or not.

To cancel a timeshare contract, you need to follow a proper procedure to make sure that the company will acknowledge your decision. Cancel in writing (this is highly recommended) and be sure to include your name as it shows in the contract, your contact details, name of the timeshare firm, description of the property, the date of purchase, and your statement that you are rescinding. You do not have to list your reason for canceling. When you are done, be sure to deliver it to the company by hand or by certified or registered mail, whichever is indicated in your contract. Just be sure that it will reach the company within the cancellation period.
